About Amendment C161egip - Lakes Entrance Northern Growth Area (Revised)
The Lakes Entrance Northern Growth Area (LENGA) was rezoned for residential development in 2014 however growth has been slow and the current planning controls are extremely complex. Council has undertaken a review of the planning controls and the challenges the LENGA has faced since 2014 and in response, has prepared Planning Scheme Amendment C161egip to the East Gippsland Planning Scheme (the Amendment).
The changes are designed to simplify the planning controls to support development over a 30-plus year timeframe. The changes will also put less of the planning burden on individual landowners because Council has updated all of the background reports and intends to also prepare a Development Plan for the whole precinct.

The key changes proposed by the Amendment are:
- Remove the Development Contributions Plan Overlay (DCPO) from all land within the LENGA. The overlay has not worked in terms of funding infrastructure and is also outdated in terms of costs and infrastructure needs.
- Remove the Native Vegetation Precinct Plan (NVPP) from all land within the LENGA. The NVPP is outdated and has not been utilised. There are existing planning controls within the scheme that manage the retention and/or removal of native vegetation, meaning the NVPP is unnecessary.
- Amend the Development Plan Overlay Schedule 8 (DPO8) to simplify the control and remove it completely from land outside the LENGA. It is being removed as the land has already been developed so the control is no longer required.
- Apply the Environmental Audit Overlay to 135 Palmers Road, Lakes Entrance due to potential contamination risk that was determined as a result of recently completed Preliminary Risk Screen Assessments.
- Make minor amendments to the Design and Development Overlay Schedule 13 (DDO13), Planning Policy Framework and other operational parts of the planning scheme.

The Amendment is at Exhibition stage, so if you have any feedback on the proposed changes, submissions can be made until close of business 21 September 2026.
There are no specific requirements for a submission, but it should:
- be received by Council before the advertised closing date of 21 September 2026
- clearly identify the amendment by the amendment number
- have your name, address and contact details during office hours
- set out your views on the amendment (for example, why you support or oppose the amendment and how the amendment will materially affect you)
- set out what you would like the planning authority, Council, to do (for example, abandon the proposal completely, exclude certain land from its effect, include additional conditions on a proposed use or approve the amendment as exhibited)
